Following are specific cases; Circuit Court of Fauquier County. Testified at deposition on the standard of care required of an attorney for the perfection of certain security interests. Did not testify at trial because the case settled. Do not remember name of case. Deposition occurred in 1986 or 1987; United States District Court for the Eastern District of Virginia. Testified at deposition and trial on the standard of care required of an attorney in the perfection of appeals and maintenance of supersedeas bonds in the Fourth Circuit. Do not remember the name of the case. 1992 or 1993; Circuit Court of Fairfax County. Testified as to the standard of care required of an attorney in the representation of the seller in take-back financing in the sale of a business, particularly as regards perfection of security interests and ensuring that appropriate remedies for the seller were established and protected. 1997; Circuit Court of Fairfax County Sealed record. Rendered opinion as to the customary practices in Northern Virginia for certain aspects of withdrawal of partners from a law firm and the formation of a new firm. Opinion involved contract issues and fiduciary obligations of partners. Case settled prior to deposition; Circuit Court of Virginia Beach. Lyle, Siegel, Croshaw & Beale v. Tidewater Capital, 249 Va. 426, 457 S.E.2d 28 (1995). When I became involved, the case had been remanded for new trial by the Virginia Supreme Court. Rendered opinion and testified at deposition on numerous issues relating to the standard of care of a law firm and its individual attorneys in the representation of a lender in financing arrangements with a business, including whether certain advice should have been given, and fiduciary duties of partner in the law firm that represented a client in which the partner had a 50% interest Did not testify at trial because the case settled. 1996-97; Circuit Court of Virginia Beach. Moore v. Strelitz, Law No. 97-2933-00. Judge wanted an affidavit of an expert witness on the meaning of the term "payment in full" as used in the banking industry and whether the note in question had been paid in full. Affidavit submitted to court 11/3/99. Plaintiff non-suited; Circuit Court of Fairfax County. Nguyen & Bui v. Vangellow; Little Saigon v. Vangellow. Malpractice case. Whether lawyer violated standard of care in giving and not giving certain advice; whether certain documents relating to a sale of a business were enforceable; whether the lawyer should have advised the client(s) that they were not enforceable. Designation filed. Did not testify because case settled; U.S. District Court, E.D. Va. (Norfolk). Travelers Cas. & Sur. Co. v. Robert W. Baird & Co., et. al. Guardianship account. Issues were interpretation of contract between bank and company, payment of check over forged signature, and breach of fiduciary duty. Report filed 5/24/01. Case settled.
