Biography

Gregory A. Nylen has more than 33 years of experience in litigating complex commercial cases across many industries. He handles matter over a wide range of areas, including intellectual property disputes, entertainment litigation, anti-counterfeiting enforcement for luxury brands, food and beverage law, class action defense, banking and financial institution litigation, and general business litigation. His clients include the owners of significant intellectual properties, including copyrights, trademarks, and domain names, as well as businesses involved in sophisticated commercial litigation.

Greg is the co-host of the Unfair Competition Defense Podcast, which provides in-depth analysis of new developments in caselaw and defense strategies relating to unfair competition and consumer protection statutes at the state and federal levels.

Experience: Representative Matters: Obtained a complete defense verdict for a software company in a bet-the-company federal jury trial involving copyright and trade secret claims. Also obtained a monetary spoliation sanctions order of over $45,000 against the opposing party in the case.; Seized millions-of-dollars-worth of counterfeit merchandise in dozens of trademark infringement actions on behalf of international trademark owners.; Shut down hundreds of unauthorized retailers of merchandise bearing clients' marks and using clients' copyrighted materials.; Conducted intellectual property audits for numerous companies.; Represented the best-known variety-show host in Latin America and numerous celebrities in disputes regarding infringing domain names.; Enjoined the misappropriation of trade secrets by a competitor of one of the world's largest processors of credit card transactions.; Represented online service providers in litigation involving web site development, issues arising under the Digital Millennium Copyright Act and Communications Decency Act.; Prevailed at trial in trademark infringement action against manufacturer of infringing bourbon brand.; Defended putative class action against a major retailer of pre-paid calling cards in UCL and CLRA case concerning alleged improper fees and surcharges applied against talk time; convinced opposing counsel in a similar, prior lawsuit to drop the case after GT filed motion to dismiss.; Defeated class certification motion on UCL case filed against major ticketing manufacturer relating to alleged false advertising of various charges.; Defeated class certification of unfair competition claims filed against publicly traded for-profit owner of various trade schools.; Defending numerous putative class actions alleging claims under UCL, FAL and CLRA against other trade schools, including in San Francisco Superior Court.; Represented a cooperative of rural telecommunications providers in a nationwide class action against the provider of satellite broadcast services.; Defended numerous companies in consumer class actions involving claims under California's Business and Professions Code sections 17200 and 17500, as well as the Consumer Legal Remedies Act.; Defended a writer and director in a major right of publicity case in the California Supreme Court.; Represented both writers and production entities in WGA credit arbitrations.; Defended numerous copyright infringement actions on behalf of a major production company.; Handled numerous contract disputes on behalf of a major talent agency.; Obtained $8 million+ judgment against former executives of major shoe retailer who embezzled funds from the company.; The above representations were handled by Mr. Nylen prior to his joining Greenberg Traurig, LLP.
