Ian R. Lifshutz

Ian R. Lifshutz is a graduate of St. John’s School of Law admitted to practice law in New York, New Jersey, Florida and Connecticut. He has extensive experience in Health Care Law and was recently recognized by the 112th Congress for his expertise in his health care law and representation of physicians and health care providers and frequently handles representing providers in Medicare and Medicaid and insurance audits of providers, the purchase and sale of health care practices, asset protection to insulate physicians and other providers and their practices from malpractice claims to their civil liability, management (MSO) and billing companies, shareholder agreements, formation, dissolution and hospital privilege disputes, operation of professional corporations and other professional partnerships. He has experience in issues surrounding Anti-Kickback and “STARK”, state and federal prohibition against self-referral law as well as professional misconduct and “Fee Splitting” issues, the formation and application and operation of Article 28 Diagnostic and Treatment Centers, hospitals, Surgi centers, home health care agencies (including the preparation of specialized Certificate of Need (CON) agreements), employment agreements, OASAS facilities, home health care agencies for the facility’s review by the state, the purchase and sale of health care practices, management service organizations (MSO), shareholder agreements, the formation, dissolution and operation of corporations and professional partnerships, medical facility leases and real estate transactions, HIPAA, Fraud and Abuse and Medicaid/Medicare compliance plans.

Mr. Lifshutz has structured many health care facilities both in New York, New Jersey and Florida, including proper pension structuring in order to maximize pension benefits. He has negotiated complex transactions for surgery centers and Article 28 facilities, and structured complex Asset Protection for physicians and others in the field of health care. He has lectured regularly at the Bronx County Medical Society and N.Y. Chiropractic College regarding HIPAA compliance, asset protection, fraud and abuse and regulatory issues surrounding health care professionals.
