John D. Hemmings, III

John Hemmings is an associate at Starnes Davis Florie LLP. John’s practice is devoted to civil litigation with a focus on medical malpractice defense and professional liability. While attending law school, John was a member of the Alabama Trial Advocacy Team, where he received the George Peach Taylor Award for Excellence in Trail Advocacy his 2L and 3L year. He was a member of the Federalist Society, the Law and Economics Society, served in the criminal defense clinic and civil law clinic providing legal advice, assistance, and representation on criminal and civil matters to those who could not afford an attorney, and was appointed to Order of the Barristers.

Highlights

Secured a writ of mandamus from the Alabama Supreme Court in Ex parte Alabama-West Fla. Conference of the United Methodist Church, Inc., directing the trial court to dismiss the plaintiff’s complaint for lack of subject matter jurisdiction under the ecclesiastical abstention doctrine, as the dispute centered on an internal church disaffiliation vote rather than a neutral property issue (Plaintiff’s have filed an application for rehearing).
