Biography

John H. FitzSimons has expertise in directors and officers liability coverage matters, as well as other management, professional and financial lines liability coverages, insurance bad faith, fiduciary coverage, and complex commercial insurance coverage.

For over 30 years, his practice has focused on contentious and non-contentious coverage analysis for thousands of complex claims involving securities class actions, shareholder derivative actions, SEC investigations, creditor claims, including those involving Enron, Worldcom and the 2008 financial crisis. A considerable portion of Mr. FitzSimons’ work has an international reach as he has frequently advised clients based in the London market on cross-border exposures, interfacing with counsel outside the U.S..

He regularly participates in mediations, arbitrations and lawsuits involving coverage disputes and has been involved in declaratory judgments actions, including many venued outside the U.S., supporting coverage determinations as well as facilitating hundreds of settlements.
