Biography

Joshua S. Kincannon is Counsel in the Mass Torts & Class Action department at Wilentz, Goldman & Spitzer.  He has helped recover millions of dollars for victims of defective medical devices and implants throughout the country.  His practice centers on product liability litigation, specifically defective knee, hip, shoulder and wrist implants, as well as other serious personal injury cases and class actions.  As an associate, Josh litigated cases against several medical device manufacturers who utilized a sterilization process that destroyed the plastic components of knee and hip implants, resulting in implant failures and revisions for hundreds of patients.  Thereafter, Josh recognized a need to get useful information into the hands of patients, and so he created in 2002.  Josh continues to help dozens of clients every year throughout the country that have been implanted with unsafe, failed, or defective medical device implants.  Some recent litigations and appointments  include:   -Appointed Lead Counsel for all plaintiffs in, In Re Physiomesh Litigation MCL No.: 627.   -Appointed co-lead counsel for all plaintiffs in the Depuy ASR Hip Implant Multi-County Litigation in New Jersey. This litigation recently settled with a settlement valued at $2.5 billion dollars.   -Identified and developed a product liability claim against the makers of the Artelon Spacer thumb implant. These cases were consolidated as a Mass Tort known as the In re Artelon Spacer Implant Litigation in the Philadelphia Court of Common Pleas. The victims agreed to a confidential settlement. Swedish defendant Artimplant AB filed for bankruptcy and no longer sells this implant in the United States.   -Appointed to the Science Committee for the Stryker Rejuvenate Hip Implant Multi-County Litigation for the State of New Jersey. Case settlement of $1 billion includes the largest individual base award for a hip implant in any mass tort settlement in the country.   As an associate, Josh worked with plaintiffs’ liaison counsel in a historic consumer fraud national class action, Talalai v. Cooper Tire & Rubber Co., a case that resulted in a settlement valued between $1 billion and $3 billion to consumers. He also worked with lead counsel on behalf of plaintiffs in one of the largest pollution cases in New Jersey, Janes v.
