Biography

As a strong advocate for the most defenseless members of society, Kimberly Barone Baden seeks accountability and compensation for victims of corporate misconduct, medical negligence, harmful medical drugs and devices as well as environmental toxins through mass tort litigation.

Kimberly represents veterans, their families and civilians who were exposed to contaminated water at Marine Corps Base Camp Lejeune between Aug. 1, 1953 and Dec. 31, 1987 and were subsequently diagnosed with conditions including:

Bladder Cancer
Kidney Cancer
Liver Cancer
Leukemia
Multiple Myeloma
Non-Hodgkin’s Lymphoma
Parkinson’s Disease
Systemic Sclerosis/Scleroderma
Aplastic Anemia
Other kidney disease/end stage renal disease

She also represents children exposed in utero to the contaminated water at Camp Lejeune who were born with severe birth defects.

Kimberly is no stranger to birth defect litigation. Over the years she has represented hundreds of children with birth defects allegedly caused by antidepressants, including Zoloft, Effexor and Wellbutrin; as well as Zofran which is used to prevent pregnancy-related nausea and vomiting. She previously litigated against GlaxoSmithKline in the Paxil birth defect litigation. She served as co-lead counsel for In re Zofran (Ondansetron) Products Liability Litigation MDL 2657, held a seat on the Plaintiffs’ Steering Committee In re Zoloft (sertraline hydrochloride) Products Liability Litigation MDL 2342, and was appointed to the Plaintiffs’ Executive Committee for In re Viagra (Sildenafil Citrate) Products Liability Litigation MDL 269. She has also managed the firm's pharmaceutical litigation regarding Crestor, Lipitor, Actos, Risperdal, incretin mimetics, and dialysis products GranuFlo Powder and NaturaLyte Liquid acid concentrates.

Kimberly also represents elderly victims of abuse and neglect, litigating cases against nursing homes and assisted living facilities.

Kimberly has spoken at numerous seminars, legal gatherings, CLEs and conferences across the U.S., including the American Association for Justice, Mass Torts Made Perfect and the National Business Institute. She has addressed a broad range of topics related to pharmaceutical drugs and elder law litigation, focusing on MDL procedures, birth defects, nursing home litigation, discovery, trial strategy and mediation. Kimberly is the former chair of the American Association for Justice’s Section on Toxic, Environmental and Pharmaceutical Torts.

Prior to joining Motley Rice, Kimberly worked on the Fen-Phen diet drug litigation and served as an attorney with the California District Attorney's Office in San Diego. Kimberly is recognized as an AV rated attorney by Martindale-Hubbell. She also proudly serves on the Board for Camp Happy Days, which offers support, encouragement and year-round programs, special events and access to crisis resources to children diagnosed with cancer and their families.
