Biography

Lynn L. Bergeson, Managing Partner of Bergeson & Campbell, P.C. (B&C®), has earned an international reputation for her deep and expansive understanding of the Toxic Substances Control Act (TSCA), the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), the European Union Registration, Evaluation, Authorization and Restriction of Chemicals (REACH) regulation, the Food Quality Protection Act (FQPA), and especially how these regulatory programs pertain to nanotechnology, industrial biotechnology, synthetic biology, and other emerging transformative technologies. Ms. Bergeson’s peerless mastery of the complex interplay between chemical innovation, regulatory oversight, policy making, and product commercialization, and her decades of experience as an entrepreneur and business owner, allow her to develop client-focused and business-sensitive strategies whether advocating before the U.S. Environmental Protection Agency (EPA), the U.S. Food and Drug Administration (FDA), U.S. state regulatory agencies, or other governance and standard-setting bodies.

Ms. Bergeson employs a highly sophisticated, nuanced approach to problem solving as she assists corporations, trade associations, and business consortia to commercialize new technologies, access new markets, extend the commercial life of an efficacious chemical product, obtain a derogation of a chemical use, or secure a competitive advantage in a new market or territory. Ms. Bergeson is a tireless and dynamic advocate for clients commercializing new chemicals with environmental, financial, and performance benefits for both industry and populations. She counsels clients on a wide range of issues pertaining to product stewardship; chemical hazard, exposure, and risk assessment; risk communication; minimizing legal liability; and product lifecycle strategy.

While she is widely regarded as the preeminent attorney in chemical and chemical product regulation and policy, Ms. Bergeson knows that clients seek more than sophisticated legal strategy: they require a business partner who will help them harness evolving global regulatory and policy matters to enhance company value and growth. As an entrepreneur with an innate understanding of the myriad challenges that face successful chemical business enterprises, Ms. Bergeson delivers vital expertise not only on regulatory compliance but on commercial market strategies. Ms. Bergeson deploys a unique business model — composed of law firm, consulting firm, and consortia management firm — to help clients accelerate commercialization of new substances and products. Under her leadership, this trio of companies provides unparalleled support across jurisdictions and cultures, ensuring superior client service worldwide.

Ms. Bergeson’s focus has always been directed both at serving clients and the common good. She served as chair of the American Bar Association (ABA) Section of Environment, Energy, and Resources and as chair of the International Bar Association (IBA) Agriculture and Food Section. She has served on the Board of Directors of the Environmental Law Institute (ELI), the NanoBusiness Commercialization Association, and is a recent past President of the Product Stewardship Society. Ms. Bergeson is a Fellow of the American College of Environmental Lawyers (ACOEL) and serves as a Regent and on its Executive Committee. Ms. Bergeson has become the driving force behind community events such as the yearly TSCA Symposium with the Environmental Law Institute (ELI) and the George Washington University Milken Institute School of Public Health. Where no organization exists to address a critical factor in the safe and reliable regulation of chemicals and products, Ms. Bergeson forms it, as she did with the Biobased and Renewable Products Advocacy Group, the Coalition for Chemical Innovations (CCI), and the TSCA New Chemicals Coalition.

In addition to publishing scores of articles and books on legal, regulatory, business, and science policy issues, since 2018 Ms. Bergson has hosted the “All Things Chemical®” podcast, engaging listeners with intelligent, insightful conversation with global regulators, industry leaders, non-governmental organization (NGO) advocates, and legal and scientific peers and colleagues. Ms. Bergeson is also President of The Acta Group (Acta®), B&C’s scientific and regulatory consulting arm, which assists chemical and product manufacturers in marketing and sustaining their products globally, and President of B&C® Consortia Management, L.L.C., which helps the chemical industry leverage resources and maximize impact by forming consortia to achieve shared research, testing, regulatory, and access goals.

For her work on behalf of clients, Ms. Bergeson has earned the highest rankings and accolades awarded to lawyers, with inclusion in Super Lawyers, Best Lawyers, Who’s Who Legal, Martindale Hubble, and more than 20 years in Band 1 of the Chambers & Partners USA Guide (Chambers). According to commentary accompanying her rankings in Chambers: “The universally highly regarded Lynn Bergeson of Bergeson & Campbell, P.C. has developed an enviable reputation in chemical and pesticide regulatory work;” “[She is] the best nationwide practitioner on product-related environmental regulations; a true expert;” “She is one of the deans in the field” and “THE person for chemical issues.”
