Biography

Madeline Smith specializes in regulatory compliance under environmental laws, with a particular focus on regulation of chemicals and chemical products, including the Toxic Substances Control Act (TSCA), the Resource Conservation and Recovery Act (RCRA), section 112 of the Clean Air Act (CAA), and the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Her work includes regulatory compliance counseling, inspection and enforcement defense, and participating in federal rulemaking procedures through complex rule analysis and drafting technical and legal comments.

Prior to joining Keller and Heckman, Madeline held Legal Intern positions for both EPA’s Office of General Counsel and the U.S. Attorney’s Office for the District of Columbia, Special Proceedings Division. During law school, Madeline was a Notes Editor on George Mason Law Review, served as the Vice President the Women’s Law Association, and was the Vice President for the Society of Environmental and Energy Law.

Representative Matters

• Drafted comments on significant U.S. Environmental Protection Agency (EPA) rulemaking and other proposals, including proposed TSCA risk evaluations for High Priority Chemicals

• Compliance advice on the application of federal, state, and international hazardous waste rules to EV battery recycling programs

• TSCA counseling on the regulation of biotechnology products and new chemical notifications

• Monitoring and analysis of international, federal, and state legislation and regulation of per- and polyfluoroalkyl substances (PFAS) and microplastics

• Counseling on the regulation of pesticide devices under FIFRA and state laws
