Biography

Marco Koshykar joined Whiteman Osterman & Hanna as a partner in January 2025. Marco was previously a partner with Nolan Heller Kauffman LLP, which he first joined as an associate out of law school in September 2004. He has over twenty years of experience in the practice areas of creditors’ rights, business and commercial law and litigation, banking and financing transactions and bankruptcy, insolvency and business reorganizations, with extensive experience in commercial foreclosure, workout and collection matters. He currently resides in East Greenbush, New York with his wife, two teenage children and a spirited cockapoo named Archie.

Representative Accomplishments

• Representation of major national banking associations and lending institutions in numerous commercial foreclosure and collection actions throughout New York State on debts ranging from $50,000 to over $10,000,000.

• Representation of secured lenders in the negotiation and documentation of numerous loan workout agreements, forbearance agreements, loan sales and loan restructurings involving businesses located throughout New York State, Vermont, Massachusetts and Connecticut.

• Representation of secured lenders in repossessing and liquidating collateral pursuant to UCC Article 9 involving restaurant equipment, commercial vehicles, industrial equipment and intangibles, including accounts receivable collections and disputes over priority of security interests.

• Representation of commercial lenders and business clients in commercial litigation matters throughout New York State and federal courts, including appeals.

• Representation of parties in real estate transactions throughout New York State, including lender representation in commercial real estate financing transactions and construction loans.

Marco is a member of the New York State Bar Association, a member of the Albany County Bar Association, a graduate of the Capital Region Chamber of Commerce Leadership Tech Valley Class of 2012 and a qualified mortgage foreclosure referee in several upstate New York State Counties. Marco is also a member of the Upstate New York Turnaround Management Association.

Background/Education

Marco graduated from the Syracuse University College of Law (J.D., magna cum laude, 2004) where he was a member of The Justinian Society and Lead Articles Editor of the Syracuse University Journal of Law & Technology. Prior to law school, Marco graduated from Ithaca College (B.S., cum laude, 2001) with a degree in Business Administration.
