Biography

EXPERIENCE: Michael Potenza is a member of the firm's Intellectual Property Group. Mr. Potenza's practice focuses on a wide variety of litigation involving the Internet and intellectual property matters, and he has counseled, among others, the National Football League, National Basketball Association, National Hockey League, The New York Times Company, The Washington Post Company, Gannett Company, Newsday, Mead Data Central, Alcon Laboratories, Sony Pictures Entertainment and Amazon.com on copyright, trademark and other intellectual property rights. Mr. Potenza has authored or co-authored a variety of articles on litigation and intellectual property issues, including "Developments in Consumer Fraud Class Action Law," Patents, Copyrights, Trademarks and Literary Property Course Handbook, 537 PLI/Pat 237 (1998), "Cert. Granted: The Practical and Jurisprudential Reasons New Jersey Should Adopt a Certification Procedure," 29 Seton Hall L. Rev. 491 (1998), a series of articles on copyright and trademark in Sports Trend (2000), "Farewell to Archives," Legal Times (April, 2001), "Another Look at 'Tasini'," Legal Times (May, 2001), "The True Significance of the Mylanta Night Time Strength Decision to the Advertising Community," Advertising Compliance Service (October, 2002), "Statutory Damages and the Copyright Act — When and How Much?", Cyberspace Lawyer (February, 2004) and "Attack of the Hacks: Using the Computer Fraud and Abuse Act to Stop a Hacker Dead in His Tracks," Metropolitan Counsel (July, 2004). Mr. Potenza also co-authored a study performed at the request of the Japanese government regarding the Internet, entitled "Report to the Institute of Intellectual Property Committee on Research and Analysis Regarding Protection of Trademarks on the Internet" (1999) and has served, since 2001, on the Trademark and Unfair Competition Committee of the Association of the Bar of the City of New York. Mr. Potenza joined Debevoise in 1997. He graduated magna cum laude from Yale College in 1990, where he received a B.A. in History, and from Harvard Law School, where he received a J.D. magna cum laude in 1995. Mr. Potenza also has served as a Law Clerk to the Honorable William G. Bassler, US District Court for the District of New Jersey and to the Honorable Samuel A.
