Michael V. McCubbin: Attorney with Levin & Perconti

Biography

From a young age, Mike was driven to practice law by a desire to advocate on behalf of victims and fight for their right to recover from harms they have suffered. His competitive spirit led him to the area of medical malpractice, where he is focused on helping clients receive compensation and future medical care, after having suffered serious loss, death, or injury through no fault of their own. Throughout his career, Mike has seen how the system is built to protect doctors, hospitals, and their insurance companies, and he spends his time fighting against that inequity to help victims and their families.

Since law school, Mike has focused on developing trial advocacy skills, which he has employed during his career to secure significant victories for his clients. Mike’s extensive experience in medical malpractice matters has included trials throughout Maryland, D.C., and several states around the country, including in federal courts, as well as arguing matters before the Supreme Court of Maryland.

Prior to joining Levin & Perconti, Mike spent years representing plaintiffs in medical negligence cases at one of the largest medical malpractice firms in Maryland; here, he handled cases around the United States. Mike then served as the Founder and Chair of the Medical Malpractice Department at a Maryland personal injury firm, where he prosecuted medical malpractice cases throughout the State.

Mike believes in getting to know his clients and their stories and that each client is unique, requiring individualized attention, time, and energy. Currently, his practice focuses on representing and advocating for children harmed in birth injury and birth trauma cases, including cases of cerebral palsy, Erb’s palsy, and developmental delay.

Mike was trial counsel in one of the Nation’s Top 100 Verdicts in 2020 against one of the largest hospital systems in the State of Maryland, after a jury awarded his client over $5,500,000 due to her death from complications of open-heart surgery. Based on this impressive result, Mike was invited into Best of the Bar, a nationwide organization that only awards membership to those attorneys who have achieved one of the top 100 verdicts in the entire United States for a given calendar year. Additionally, in 2021, Mike was offered admission into the National Trial Lawyers’ – Top 40 Under 40, after he was identified as one of the top trial attorneys in the area of medical malpractice. Mike has also been named to America’s Top 100 High Stakes Litigators.

Throughout his career, Mike has secured millions of dollars for his clients in medical malpractice matters, through a combination of jury verdicts and settlements. He provides aggressive and focused representation and seeks to maximize his clients’ recovery through creative, detail-oriented, and innovative trial strategies, medical and legal theories, and unique presentation to the jury.

For years, Mike represented doctors and hospitals in medical malpractice claims. However, he soon realized that his trial skills and passion were better served representing victims of medical malpractice, rather than those accused of committing malpractice. Now, Mike uses the skills, knowledge, and insight he learned while defending medical malpractice claims; he knows the medical-malpractice-defendants’ “play book” from his inside experience and now uses that knowledge to help victims of medical malpractice.

Mike served as a Chairman in the Young Lawyers’ Section of the Maryland State Bar Association and remains active in the Maryland Association for Justice and American Association for Justice, which focus on plaintiffs’ rights in medical negligence and personal injury cases. He has also lectured and published articles on medical malpractice matters. He lives in Annapolis with his wife and daughter. In his spare time, he enjoys time with his family, exercise, golf, movies, and reading.
