Biography

Michael Boldt advises clients on a broad range of energy and complex litigation matters. He represents clients in all phases of litigation, from contested cases before administrative agencies, bankruptcy courts, state and federal district courts and courts of appeal.

Prior to joining Eversheds Sutherland (US), Michael worked at an international corporate and litigation law firm where he gained substantial experience handling contested administrative cases, litigation in federal and state courts and appeals.

Experience

Special Counsel to the debtor in Brazos Electric Power Cooperative’s adversary proceeding, Brazos Electric Cooperative, Inc. v. Electric Reliability Council of Texas, Inc., S.D. Tex. Bankruptcy.
Defended state transmission siting legislation against constitutional Commerce and Contracts Clause challenges.
Obtained mandamus reversal of a temporary restraining order that would have prohibited the energization of a $300 million transmission line in South Texas.
Defended an electric utility in a multimillion-dollar contract dispute in Dallas County, Texas.
Argued and obtained rehearing in the appeal of a construction finance case involving contract and fraud claims.
Obtained disqualification by mandamus of plaintiffs’ counsel in multiparty, multiforum litigation in South Texas.
Uncovered plaintiffs’ fabrication of evidence in a breach of contract case, obtained civil “death penalty” sanctions, and successfully defended the judgment on appeal.
Obtained dismissal of a shareholder class action alleging violations of federal securities laws related to a $26 billion going-private transaction.
Obtained dismissal of an indictment against an international energy company for alleged violations of political campaign finance laws.
Won the appeal of an agency’s decision on federal income taxes in an electric utility rate case.
Assisted in obtaining complete defense verdict in favor of corporate client in South Texas jury trial involving nuisance, conversion, and condemnation claims.
Defending constitutionality of state certification statute against Commerce Clause and Contracts Clause challenges.
Obtained state certification to construct large CCGT plant in MISO.
Represented a Texas electric utility in a base rate proceeding and successfully negotiated a settlement.
Represented a Texas electric utility in 2016 rate case.
