Biography

Max’s practice primarily focuses on intellectual property creation, counseling, and disputes, particularly within the areas of patent prosecution and litigation. His practice extends to a wide variety of complex technologies, including robotics, consumer electronics, electric motors, semiconductor devices, financial technology, artificial intelligence applications, blockchain systems, telecommunications, vehicle and aircraft control systems, and hybrid/electric vehicles. Max has managed the creation of patents and disputes for his clients in these technologies and more.

Max’s litigation experience informs his patent creation and portfolio management expertise, allowing him to guide clients on the impact and reach of their products and intellectual property. Max has gained his litigation experience by challenging and defending patents among a variety of forums, including in post-grant proceedings at the U.S. Patent and Trademark Office (USPTO), the International Trade Commission (ITC), federal district courts across the U.S., the U.S. Court of Appeals for the Federal Circuit, and the U.S. Supreme Court. In the USPTO, Max has participated in dozens of Inter Partes Review (IPR) and Ex Parte Reexamination proceedings. In district court and ITC proceedings, his litigation experience ranges from pre-suit planning and strategy to motion practice, discovery, depositions, claim construction, summary judgment, trial, and post-trial briefing.

In addition to his patent work, Max has counseled clients in the creation and protection of trademarks and trade secrets. Max has also participated in the negotiation and execution of intellectual property agreements and contracts to resolve or pre-empt disputes.

Max’s engineering background is based on designing and overseeing the implementation of various systems, including suspension, powertrain, and software systems, for vehicles and aircraft. He gained practical knowledge as a design and strength engineer for two aircraft manufacturing companies.

Max is committed to providing quality pro bono legal aid. He consistently takes on a diverse range of projects to provide support for those in need.

Representative Matters

In the Matter of Certain Power Inverters and Converters, Vehicles Containing the Same, and Components Thereof: Represented BMW through trial, resulting in finding non-infringement of BMW’s products and invalidity of plaintiff’s patent.°

Ericsson Inc. v. TCL Communication Technology: Joined the matter after a TCL received a judgment of willful infringement, which resulted in a damages award of over $110 million. Convinced the Federal Circuit that the claims were patent ineligible under 35 U.S.C. § 101, and the court reversed the district court’s ruling of no invalidity, vacated the entire judgment against TCL, and awarded costs to TCL. Based on that award, further persuaded the Eastern District of Texas to tax $2.35 million in costs.°

Nissei ASB Co., et al. v. R&D Tool & Engineering Co.

Tcl Commc’n Tech. Holdings, Ltd. v. Telefonaktiebolaget LM Ericsson: Drafted briefing and second-chaired oral argument that led to reverse of $75 million verdict, and subsequently drafted briefing to defend Federal Circuit decision against a petition for writ of cert. to the Supreme Court.°
