Robert A. Simon is a fourth generation Fort Worth lawyer who focuses in bankruptcy, bankruptcy litigation, and general insolvency.
Mr. Simon entered private practice as a bankruptcy lawyer in in 1991. Since then, Mr. Simon has represented nearly every type of player in the bankruptcy arena, including debtors, bankruptcy trustees, commercial banks, non-bank lenders, unsecured creditors, equity holders, local taxing authorities, municipalities, official creditor committees, ad hoc (unofficial) creditor committees, asset purchasers, new equity investors, court-appointed professionals, and numerous defendants in preference and fraudulent transfer litigation.
As debtor’s counsel, Mr. Simon has successfully led the reorganization of numerous local and regional companies. As counsel for judgment creditors in the Pittsburgh Corning Chapter 11 case, Mr. Simon helped change the nationwide template for the treatment of judgment creditors in asbestos bankruptcy cases. As litigation counsel for Placid Oil Company, Mr. Simon successfully resolved eight cases involving the discharge of pre-bankruptcy legacy claims against Placid Oil and obtained two favorable rulings from the Fifth Circuit Court of Appeals regarding the discharge of such claims. As co-counsel for Rangers Baseball Express, LLC, Mr. Simon helped represent the successful purchaser of the Texas Rangers Baseball Team in the Team’s 2010 bankruptcy.
Mr. Simon believes that formal bankruptcy proceedings are an expensive solution to debtor-creditor disputes and strives to resolves disputes informally through negotiation, if possible. Often, debtors and creditors can resolved their disputes more swiftly and more economically outside of bankruptcy. Mr. Simon prefers that approach, when possible, and has extensive experience in informal workouts, representing both debtor and creditors. In addition to bankruptcy and insolvency, Mr. Simon practices commercial litigation, real estate, and general business law.
