Biography

Oscar E. Peralta is an associate in the Labor and Employment practice group. Oscar focuses his practice on defending employers in complex wage and hour class, collective, and PAGA actions. He also represents employers in individual actions involving claims of discrimination, harassment, retaliation, wrongful termination, and misclassification. In addition to his litigation practice, Oscar collaborates with employers to update and implement wage and hour policies consistent with business operations and goals.

Obtained damning documentary and deposition evidence to support counterclaims including fraudulent concealment and intentional misrepresentation, which resulted in plaintiff agreeing to pay client to resolve the lawsuit they had initiated.; Ongoing defense of fast casual restaurant chain from putative class and PAGA claims alleging unpaid overtime, unpaid minimum wages, failure to provide accurate wage statements, failure to pay wages due at termination, and failure to reimburse business expenses.; Obtained dismissal with prejudice of PAGA representative action. Compelled plaintiff's individual wage and hour claims to arbitration. In arbitration, secured dismissal of all Counts with prejudice following multiple rounds of strategic discovery and pleading challenges. Judgment was then entered in favor of client in Superior Court and plaintiff's PAGA representative claim was dismissed with prejudice due to lack of standing.; Represented logistics service provider company in putative wage and hour class and PAGA action and obtained early settlement.; Represented senior living management company in complex wage and hour class, collective, and PAGA action involving over 20,000 individuals across the United States.; Represented food and environmental testing laboratory company in wage and hour class/PAGA actions involving claims for unpaid wages, meal and rest period violations, non-compliant wage statements, and unreimbursed business expenses.; The above representations were handled by Mr. Peralta prior to his joining Greenberg Traurig, LLP.
