Biography

Richard E. Weltman is recognized by his peers as an aggressive litigator and skilled negotiator with over 47 years of experience handling diverse matters. Richard engages in the general practice of law with a concentration in business and bankruptcy counseling and problem-solving. He regularly handles matters arising out of the creditor and debtor relationship, often concerning financially distressed companies, asset preservation, private sales, online auctions, rights enforcement, and asset recovery.

Representative clients include banks, credit unions, asset-based and MCA lenders, finance companies, venture capital, equipment lessors, insurers, manufacturers, importers, distributors, developers, entrepreneurs, medical, legal, accounting, and design professionals, construction trades, artists, founders, investors, owners, senior managers, employees, contractors, and parties in interest—across multiple sectors including, among others, retail, hospitality, entertainment, media, marketing, financial services, technology, fintech, block chain, Web3, digital assets, IP protection and licensing, estate administration, crypto, and cannabis—for diverse organizations such as family offices, content creators, corporate counsel, advisors, partnerships, limited liability companies, and nonprofit entities.

In addition, Richard represents debtors, secured and unsecured creditors, receivers, fiduciaries, restructuring officers, committees, and counterparties in connection with a wide range of business and bankruptcy transactions and contested matters, including distressed assets, preference and fraudulent conveyance adversary proceeding cases, lien priorities, proofs of claim, reorganization and liquidation plan confirmation, adequacy of disclosure statements, motion practice, equitable remedies, debt discharge, dischargeability, and involuntary cases.

Richard graduated cum laude from Delaware Law School of Widener University, earning his Juris Doctor degree in 1978. While in law school, he was elected to Moot Court Honor Society, and also served as Magister of Harrington Inn of Phi Delta Phi International Legal Fraternity. He served as Managing Editor of The Delaware Journal of Corporate Law, the law review of Delaware Law School and a leading national legal publication focused on corporate governance, compliance and business law issues in general and Delaware corporation law in particular.

Richard is a member in good standing of the bars of both New Jersey and New York, and is admitted to practice before the Third Circuit Court of Appeals and the United States District Courts for the Southern and Eastern Districts of New York and the District of New Jersey. In addition, Mr. Weltman’s active professional affiliations include the Bankruptcy Lawyers Bar Association, Commercial Law League of America, and the New York State (Member, Executive Committee, Business Law Section, and Committee on Internet and Technology Law), New Jersey State (Member, Bankruptcy Law Section) and American Bar Associations. Mr. Weltman is also a member of Executive’s Association of Greater New York.

Richard received his undergraduate degree in journalism from The Ohio State University in 1975. Prior to law school, he worked in advertising and public relations honing his writing skills and producing radio and television commercials for regional and national clients. He brings to his law practice strong communication and negotiation skills and the ability to formulate creative win-win solutions that produce profitable results for his clients.
