Biography

Richard Ostriak is an experienced litigator who, over the course of 25 years, has tried hundreds of jury and bench trials, first as a public defender and then in private practice.

Richard has extensive experience in insurance litigation. Early in his career, he served as staff counsel at two national insurance companies for over twelve years, representing personal-lines insureds in major jury cases in state and federal courts throughout the Philadelphia area.

Richard represents national and local corporations, business entities, self-insured businesses, and individuals in complex and multi-party matters, including general liability, commercial casualty, construction defect, professional liability, insurance coverage, and auto and trucking.

In addition to insurance litigation, Richard’s expertise includes commercial litigation encompassing contract disputes, corporate law, and consumer law. He also has significant experience handling bad faith, contract, and first-party claims, having tried numerous cases to verdict.

Representative Matters: Premises Liability (Montgomery County, PA) - Obtained summary judgment in a roof fall accident matter where plaintiff sued client-homeowner after plaintiff fell from a ladder while performing maintenance work on the client's property. Plaintiff alleged critical injuries after he fell 20 feet from his ladder due to a defective condition of the roof, including loose roofing material that caused the ladder to become unstable. The trial court granted the defense Motion for Summary Judgment on the basis that the plaintiff failed to procure an expert on the issue of the defective condition of the roof.; Auto Liability (Berks County, PA) - Obtained dismissal with prejudice in an auto accident matter where the insured driver allegedly ran a stop sign and was struck on the passenger side by the plaintiff. After plaintiff filed a Writ of Summons, the defense succeeded in demonstrating that the plaintiff failed to perfect service of the Writ.; Construction Accident (Philadelphia County, PA) - Obtained summary judgment in a catastrophic injury construction accident matter where the plaintiff fell 15 feet, fracturing both heels and sustaining permanent disability. The trial court granted summary judgment on the issue of the client's liability as the plaintiff's employer which is barred under Pennsylvania's statutory employer doctrine.; Construction Accident (Philadelphia County, PA) - Obtained an order precluding evidence of negligence in a construction accident case where plaintiff alleged a head injury, fractured shoulder, and other injuries after he fell from a poured concrete foundation into a work pit. Plaintiff's $2.5M demand included a six figure workers' compensation lien and $1M in future medical expenses. The case ultimately settled for less than the workers' compensation lien.
