Robert A. Miklos, Esq. is a New York trial lawyer and partner at Silberstein & Miklos, P.C. in Garden City. He focuses on catastrophic injury, wrongful death and medical malpractice cases, representing injured people and families in New York City, on Long Island and throughout New York State.
Much of his work involves construction accidents under New York's Labor Law, including scaffold and ladder falls and falling-object cases under Labor Law 240 and 241, and truck and bus crashes, including MTA buses. In medical malpractice, he handles serious cases of missed or delayed diagnosis of stroke, brain bleeds, heart attack and cancer, surgical and emergency room errors, birth injuries, and hospital and nursing home neglect, including claims against NYC Health + Hospitals, where a notice of claim is due within 90 days.
He also represents people seriously hurt in car, Uber and Lyft, pedestrian and e-bike accidents, and in slip-and-fall and trip-and-fall accidents, when a commercial driver, property owner, landlord, New York City or NYCHA is responsible. Many of these cases involve surgery, such as a spinal fusion for a herniated disc or shoulder or knee surgery, or a brain or spinal cord injury.
He tries cases to verdict. In 2019, in Kings County, he won an approximately $28 million jury verdict for a man whose brain bleed was not diagnosed in time at a public hospital; after appeal, a judgment of approximately $17 million was paid in full. He has also obtained jury verdicts of approximately $4.3 million in a Westchester wrongful death case (2017), $3.5 million in a Queens delayed cancer diagnosis case (2018), $1.75 million in a Nassau birth injury case that was affirmed on appeal, and $1.5 million for an MTA bus passenger in Queens (2015). In all, he has helped recover over $100 million for injured clients. Prior results do not guarantee a similar outcome.
Other lawyers bring him in as co-counsel or trial counsel on catastrophic injury, Labor Law, wrongful death and medical malpractice cases. Referral fees are shared as permitted by Rule 1.5(g), with the client's written consent.
The Chief Administrative Judge of the State of New York appointed him to the Advisory Committee on Civil Practice, which advises on reforms to the CPLR. He is President of the Latino Lawyers Association of Queens County and founding President of the Latino Lawyers Association Scholarship Fund, Inc., and he served on the Board of Directors of the New York State Trial Lawyers Association from 2015 to 2016. He was selected to the Super Lawyers list, New York Metro (2025-2026), after Rising Stars recognition from 2015 to 2024, and holds a Martindale-Hubbell AV Preeminent rating.
