Biography

Scott Gratton began practice at the Brown Law Firm in 1988 and became a partner in 1994. He left to represent Burlington Northern Santa Fe Railroad for two years in 1996. He returned to the Brown Law Firm as a full shareholder in 1998. Scott has tried numerous jury cases in Montana’s State and Federal Courts, and has handled appeals in the Montana Supreme Court and U.S. Court of Appeals, Ninth Circuit. He is peer-review rated at the highest level of legal ability and ethics (AV) by Martindale-Hubbell. Scott is an experienced trial attorney with over 25 years of experience in several different areas of law including: civil litigation, property and casualty, products liability, insurance coverage, insurance defense, environmental litigation, FELA, personal injury, both plaintiff and defense, accounting malpractice and legal malpractice defense and other commercial cases.

Scott was admitted to the Montana State Bar in 1987; U.S. District Court, District of Montana in 1988; Ninth Circuit Court of Appeals in 1988; and the Tenth Circuit Court of Appeals in 1996. Scott graduated from the University of Montana (B.A., 1984, J.D., 1987) Phi Delta Phi. He was a law clerk for the Honorable L.C. Gulbrandson of the Montana Supreme Court from 1987 to1988.

Scott is a member of the American Bar Association, Yellowstone Area Bar Association (Director, 1992-1995); Missoula County Bar Association; Montana Defense Trial Lawyers (Director, 1994-1996, 1998-1999); Editor, The Commentator, 1994-1996; Defense Research Institute; and National Association of Railroad Trial Counsel.

From the years 2008 through 2012 Scott has been recognized in The Best Lawyers in America for Products Liability and personal injury defense expertise. Scott has been selected by his peers as a Mountain States Super Lawyer for the years 2010 – 2019 in the areas of personal injury general defense. He has also been recognized in Chambers USA and Rocky Mountain “Super Lawyers” for his litigation experience. In 2008 he was appointed by Chief Federal District Court Judge Richard F. Cebull, as one of Montana’s Lawyer Representatives to the Ninth Circuit Court of Appeals and served in that role through the summer of 2011.
