On the eve of trial, Mr. V's client was injured and Mr. V asked me to agree to a postponement. I did so, with the written condition that his client's attorney fee claim be capped as of that date to avoid prejudice of delay to our client. Mr. V agreed. When the case was tried several months later, Mr. V reneged on the agreement and presented a claim for fees arising after the date of the agreement. Consequently, Mr. V lost--and has not regained--my trust.
