Biography

Thomas R. Heisler is co-chair of Greenberg Traurig’s Miami Construction Litigation Practice. An accomplished trial lawyer, he handles complex commercial litigation matters focused on disputes involving construction and real estate development projects. He routinely advises property owners and developers across the spectrum of real estate asset classes and in all phases of their construction and development projects.

His experience spans federal and state courts nationwide at both the trial and appellate level. Thomas is highly effective at communicating with juries, judges, and clients, briefing complex issues, and developing creative case strategy at trial and on appeal.

Before joining Greenberg Traurig, Thomas practiced in the Chicago headquarters of a prominent international law firm, and later as a partner at an elite Chicago litigation boutique, where he handled numerous trials and appeals.

Experience: Representative Matters: Won a multimillion-dollar jury verdict in a civil fraud case on behalf of the estate of a deceased Chicago businesswoman defrauded by a Chicago-area neurosurgeon through a contract to make a will, and successfully defended the judgment on appeal.; Obtained summary judgment for a major property management company in its defense of a lawsuit brought by a commercial property owner alleging breaches of contract, fiduciary duty, and fraud.; Represented a direct mail company in its suit against a commercial equipment manufacturer for selling client defective commercial printing machinery and successfully defeated the dispositive motions of the manufacturer before negotiating a settlement on behalf of the client.; Won a several million-dollar judgment, including punitive damages, in favor of a physician defrauded by his former business partner.; Obtained a directed verdict on behalf of an individual client in a trial arising out of a will and trust agreement.; Represented a bank in a civil RICO case in federal district court brought by a former bank customer which sought to hold the bank liable for an embezzlement scheme involving the customer's former fiduciaries.; Represented the founder of a construction company in his suit against his former business partners for various breaches of contract, fiduciary duty, and fraud in connection with numerous real estate development projects in Illinois and Florida.; Represented a charitable organization in its suit against an individual who misused powers of attorney to change the beneficiary of various POD accounts the decedent intended to benefit the organization.; Represented a securities trading firm in its defense of a case brought by a former employee, obtaining a jury verdict in the trading firm's favor.; Represented holders of a casino license in their successful appeal of a recusal challenge to a federal bankruptcy court judge, and represented the clients at a bench trial in federal district court.; The above representations were handled by Mr. Heisler prior to his joining Greenberg Traurig, P.A.
