Biography

Virginia is a shareholder and head of the UK Employment Practice with almost 20 years’ experience in helping employers to strategically manage and optimise their workforces. She offers support at every stage of the employment lifecycle, advising on the full spectrum of matters from day-to-day advisory work to complex transactions and high-stakes disputes.

Virginia is highly skilled at guiding clients through significant and often multi-jurisdictional transactions and disputes. She frequently handles contentious matters such as claims for unfair dismissal, discrimination, harassment and whistle-blowing, as well as High Court employee competition disputes. In addition, she provides practical UK employment advice across a broad range of issues, including recruitment, performance management, disciplinary and grievance processes, and exits. She regularly counsels multinational companies on global projects such as business transformations, cross-border workforce structures, and complex and sensitive employee investigations. Virginia also acts for senior executives in relation to a variety of matters, including disputes, employee competition matters, and negotiated exits.

Experience: Litigation: Acting for a software company in investigating and ultimately settling allegations of automatic unfair dismissal and disability discrimination; Defending a multinational telecommunications company against a claim of sex discrimination brought in the UK Employment Tribunal; Defending an international asset management company against a complex and high-value disability discrimination claim; Defending an international software company against an unfair dismissal claim brought by a contractor alleging he was in fact an employee; Advising various employers on restrictive covenant disputes, including the possibility of seeking injunctive relief, orders for delivery up of company property and other remedies; Counselling / Advisory: Drafting and helping to negotiate the terms of employment agreements for senior management of multiple clients; Negotiating the exit of senior executives from multiple clients, including in circumstances involving alleged gross misconduct by the employees and other sensitive and complex disputes; Advising on the management of a grievance brought by a salesperson against their employee in relation to alleged pricing irregularities and subsequent whistleblowing allegations; Guiding a pharmaceutical company through a multi-jurisdictional restructuring exercise; including advising on the UK considerations and coordinating overseas advice; Transactional: Advising on the employment law aspects of multiple corporate transactions, including share sales, asset sales, and joint ventures; Advising on the application of the TUPE Regulations to various transactions, especially those involving real estate and funds; Working alongside our restructuring team to advise on the employment law aspects of insolvency situations.
