Motor Vehicle Liability

The insured vehicle was attempting to "beat the light" by making a left turn across two lanes of oncoming traffic when it struck the plaintiff, a pedestrian crossing the intersection. The plaintiff underwent arthroscopic surgery to her right shoulder and alleged that she had sustained a significant limitation of use of her shoulder. The Court granted AGF&J's motion to dismiss based on the testimony of our defense medical expert, an orthopedic surgeon, finding that the plaintiff's injury did not meet New York State Insurance Law's "serious injury" threshold. 

AGF&J has successfully defended hundreds of automobile and no-fault actions, from the most ordinary two-car collision to accidents involving multiple vehicles and fatalities. AGF&J aggressively defends these actions as to both liability and damages. Our attorneys have a proven track record of success on threshold motions under New York State Insurance Law Section 5102(d), summary jury trials and full jury trials.
