Subrogation

A building owner's insurer paid more than $380,000 to its insured for damage to the premises caused by a fire resulting from degraded electrical equipment and an interruption in electrical service. AGF&J represented the insurer in a subrogation action to recover damages from the building's electric service provider. At trial, AGF&J's attorneys simplified for the jury complicated scientific evidence by using everyday examples, such as analogizing electrical currents to water flowing through a garden hose. The jury found the electric service provider 100% liable and AGF&J's client recovered nearly $600,000, the full amount of damages paid to the insured, plus interest.

AGF&J's attorneys review claims presented by insurance carriers for possible subrogation. Our understanding of fire "cause and origin" issues and mechanical and electrical matters and our use of highly-competent technical experts enables us to devise recovery strategies to benefit our clients' interests. We promptly evaluate liability and assess the potential for recovery of these subrogation claims, which are generally handled on a contingent fee basis.
