Insurance Coverage/Bad Faith Litigation

Bailey & Dixon for decades has been recognized as one of the most prominent North Carolina firms handling insurance coverage and bad faith/first-party claims litigation in the state and federal courts. Our lawyers have steered motions, trials, and appeals in the leading cases shaping the State’s law on motor vehicle liability coverage, underinsured/uninsured motorist coverage, commercial insurance coverage, insurer bad faith, and the complex relationship among insurer, insured, and defense counsel. Our clients in these matters include North Carolina’s several largest property and casualty insurers, the State’s leading legal malpractice insurer, and some of the nation’s major commercial, excess, and reinsurers. We also routinely represent insurance brokers and other professionals on errors and omissions claims.

Our attorneys are widely regarded as among the State’s foremost experts in this practice area. Our combined experience is unparalleled, extending to virtually every geographic region within North Carolina, as well as its neighboring States.

Insurance Defense Litigation

Bailey & Dixon’s experienced insurance defense litigators are among the most recognized and highly regarded in North Carolina. We have defended individuals and companies under automobile, homeowner’s, business premises, commercial and professional liability policies, and we routinely represent insurers on claims involving uninsured/underinsured motorist and excess liability coverage. Our broad experience encompasses catastrophic personal injuries; class action litigation; construction defect litigation; discrimination, sexual harassment, workplace violence, and other employer-liability matters; heart balm actions; intentional tort claims; law enforcement officer liability and excessive force claims; motor vehicle accidents; municipal liability; premises liability; product liability; professional liability; school and education law matters; Wage and Hour Act claims; Woodson claims, and wrongful death claims, among others.

We have represented individuals, sole proprietorships, small corporations and large companies in virtually every North Carolina judicial district, in the Eastern, Middle and Western Federal Districts of North Carolina, and in the State and Federal courts of our neighboring States.

Insurance Law

For more than 50 years, Bailey & Dixon has been regarded as one of North Carolina’s most prolific and successful insurance law practices. Our attorneys generally focus on the area of defense, representing both insurance companies and individuals or companies in matters such as automobile claims, property damage claims, products liability and worker compensation claims. We provide attentive, expert counsel and work closely with our clients to ensure that each case is handled with the utmost level of care. We aggressively represent our clients' interests through every phase of an insurance defense case in order to provide the best possible result. Our years of experience and track record of success uniquely qualify Bailey & Dixon to represent insurance companies and other defendants in matters involving insurance defense.

Legal Malpractice Defense and Claim Repair

For over twenty years, Bailey & Dixon has defended and assisted lawyers through the Firm’s representation of the largest legal professional liability insurer in North Carolina. The firm regularly defends lawyers in malpractice lawsuits in both the Federal and State trial and appellate courts, and we have also assisted attorneys in proceedings before the Disciplinary Hearing Commission of the North Carolina State Bar. In addition, the Firm is frequently retained to advise lawyers or to jointly represent their clients on a limited basis in order to peremptorily repair procedural and tactical missteps which might otherwise give rise to a malpractice claim.

Our attorneys have represented lawyers and/or their clients in cases or claim repair matters involving appellate procedure, civil procedure, commercial litigation, commercial transactions, domestic law, estate planning, insurance coverage matters, medical malpractice actions, personal injury actions, real estate transactions, and wrongful death claims. Our level of success and reputation in this specialized practice area is second to none.
