Fiduciary Litigation

Duty, Loyalty, and Trust - these are three hallmarks of the fidiciary relationship.

Barley Snyder's Fiduciary Litigation Group represents individual or institutional fiduciaries or beneficiaries in matters involving breach of fiduciary duty, estate and gift taxation, will contests, challenge to fees and commissions, investment decisions and results under the Prudent Investor Rule, duty of loyalty, and trust matters under the Uniform Trust Act, including trust modification and reformation, estate administration, ERISA, guardianships, power of attorney, charitable trusts, charitable foundations, and trustee removal and surcharge.

Our Fiduciary Litigation services extend to working with trust officers, estate administrators, financial institutions, advisors and brokers, corporate ficuciaries, and investment and services companies. We:

  • Assist in compliance with statutory and common law duties of loyalty owed by professional fiduciaries to their clients.
  • Understand the nuances of the law and how professional fiduciaries serve their clients.
  • Represent all types of charitable organizations to work through issues and disputes and resolve litigation.
  • Represent individuals who have been harmed by individuals or entities who have breached their fiduciary duties.

Representative Experience

  • Regional and national corporate fiduciaries in surcharge actions involving breach of fiduciary duty and the duty of loyalty, investment strategy and return, as well as fees and commissions issues.
  • Trustees in trust matters including reformations, Prudent Investor Rule challenges, and other issues arising under Pennsylvania's new Uniform Trust Act.
  • Charitable organizations in cy pres proceedings.
  • Individuals and fiduciaries in will and trust disputes and contests.
  • Individuals and fiduciaries in contested guardianship proceedings.
  • Individuals and fiduciaries in trust, estate, and power of attorney accountings.
  • Individuals and fiduciaries in document interpretation and declaratory judgment actions.

Diversity

Barley Snyder is committed to the principles of diversity and inclusion. We believe the recruitment and retention of a diverse workforce is vital to the growth of our business and to understanding and serving a diverse client base.

Barley Snyder has invested in our goal of diversity and inclusion in many ways, including:

  • Active participation in the regional Capital Area Managing Partners Diversity Initiative Internship Program, including the hiring and mentoring of a first year minority law student;
  • Participation in the York and Lancaster County Bar Association's Diversity Committee and the York County Bar Association's Street Law Program;
  • York College Community Opportunity Scholarship Program; 
  • Participation in the annual Lancaster Chamber of Commerce Diversity Day where we have presented on issues related to diversity in the workplace; and
  • Active participation in the local communities we serve through public service.

Barley Snyder currently has fifteen female lawyers on our professional staff, eight of whom are partners. In addition, we currently employ three minority attorneys. This diverse group of professionals practices in most specialty areas offered by the firm. In addition, our Employment Law Group has two attorneys who are fluent in Spanish as well as one who is proficient in French. The Group has been able to use this expertise to review and translate employment policies, and has conducted various types of employment training on behalf of employer clients geared specifically to Hispanic employees.

Barley Snyder is also a demonstrated leader in our commitment to the advancement of women and minorities within the firm. The leaders of two of our four principal practice groups are also women, one of whom is a minority. We have also integrated women and minorities into other key leadership roles to include the Compensation Committee, the Associates Committee, the Paralegal Committee and the Finance Committee. In addition, two of our key administrative staff are women.

Barley Snyder also promotes work/life balance through its Family Leave Policy, which allows both mothers and fathers to take up to six months of leave for the birth or adoption of a child and to work a part-time arrangement in the first year following the birth or adoption of a child. In addition, we have facilitated regular part-time arrangements with our attorneys, paralegals and staff who require a more flexible work schedule due to child rearing responsibilities.

Barley Snyder's attorneys are also actively involved in public service. Our commitment to public service is reflected in our partnership criteria which counts such service as an important component to admission to partnership with the firm. In addition, our attorneys have been active in several key pro bono efforts within the region.
