Defective Products

Defective and dangerous products cause hundreds if not thousands of injuries to consumers and users of such products every year. Product liability refers to the law that governs the liability of manufacturers and others, such as suppliers, distributors, and retailers, for injuries or death caused to a consumer or user of the product by a defective or dangerous product. A product may be defective or dangerous because of a design flaw, a manufacturing defect, or because of a failure to provide warnings.

Burg Simpson’s lawyers have collectively handled thousands of product liability cases, both on the plaintiff side and the defense side. Burg Simpson’s vast experience and resources allow the firm to handle even the most complex product cases efficiently and effectively. Our product liability experience encompasses a wide array of consumer products, including:

  • Children’s Products
  • Farming Equipment
  • Motor Vehicles
  • Pharmaceutical Products
  • Medical Devices
  • Manufacturing Equipment
  • Human Tissues

We are proud of our product liability attorneys, one of whom is a former member of the ASTM, one of the largest voluntary standards development organizations in the world and a trusted source for technical standards for materials, products, systems, and services. Several other of our attorneys have taken national leadership roles in massive defective drug litigation cases.

MOTOR VEHICLE DEFECTS

Motor vehicle defect claims may be based on manufacturing or design defects in any part of the vehicle, including passenger restraints (seat belts), airbags, brakes, electrical system, engine and exhaust, fuel system, tires and steering. They may also be based on an overall design of the vehicle that makes the vehicle dangerous. For example, a design of the vehicle might make a rollover more likely, such as in the case of certain sport utility vehicles (SUVs). Passenger vehicles, vans, trucks, motorcycles, and other motor vehicles may also contain defects that cause injury.
