We frequently represent lenders seeking to appoint receivers for businesses or assets they are lending on in order to protect the lenders from the dissipation of their collateral. We also represent the Receivers who are appointed over the operation of various businesses and/or assets to assist in prosecuting actions on behalf of the Receiver, running the underlying entity, protecting properties, dealing with county and city issues and permits, and the sale of assets out of the Receivership.

Defense of judicial foreclosure and receivership action for Tennessee apartment complexes.

Distressed Commercial Properties
Successfully petitioned several Georgia Superior Courts for the appointment of receivers for a number of distressed commercial properties on behalf of lender clients.

Loan Default
Represented large national mortgage lender in case against borrower, guarantors, and transferees to collect defaulted commercial loan, have receiver appointed over collateral, and void fraudulent transfers of assets.
