Construction

Chambliss construction lawyers provide counsel in all aspects of construction law and litigation for a variety of clients, including owners, lenders, developers, general contractors, subcontractors, suppliers, design professionals, and sureties. With professional backgrounds in architecture, city planning, and engineering, our lawyers understand and are able to provide expertise in construction matters.

Chambliss’ services include:

Contract Drafting and Negotiation
Chambliss negotiates and drafts construction agreements, including agreements based on documents from the American Institute of Architects, Associated General Contractors, Engineers Joint Contract Documents Committee, and federal and state governmental entities. These agreements relate to large, complex commercial projects, as well as smaller developments, including sports stadiums, industrial and manufacturing plants, health care facilities, commercial developments, public projects, and residential developments.

Litigation and Alternative Dispute Resolution
Chambliss lawyers have litigation experience in state and federal courts, both at trial and on appeal. The firm also handles mediation and arbitration in various forums, including the American Arbitration Association and private dispute resolution services. Issues addressed and resolved include payment disputes, acceleration and delay claims, construction/design defects, materials failures, labor disputes, terminations, bid issues, and other construction issues.

Liens, Bonds, and Other Payment Remedies
Chambliss regularly provides services with respect to all aspects of mechanics' and materialmen's liens. Matters include preparing and filing lien notices, prosecuting lien enforcement actions, making and defending Prompt Pay Act claims and claims under state trust fund statutes, protecting owners from lien filings by bonds or other methods, and asserting or defending claims on payment and performance bonds, including Miller Act bonds.

The firm is actively involved in industry associations, such as the Associated General Contractors, American Institute of Architects, Construction Specifications Institute, and the Tennessee Association of Construction Counsel. Chambliss lawyers routinely present seminars on a range of topics, including construction contracts, liens payment remedies, and alternative dispute resolution. Additionally, the firm’s lawyers have consulted on other topics, including LEED standards, sustainable design and construction, Consensus DOCS, and building information modeling (BIM).

Successfully mediated and resolved a dispute involving extra-contractual and change order work on a large industrial carbon fiber manufacturing facility


Handled contract litigation involving recovery steam piping and related work at the Browns Ferry Nuclear Plant in Alabama

Recruiting

Professional & Civic Leadership

Our attorneys are involved in many civic and legal organizations, serving in board positions and volunteering time for projects that promote diversity in the community and in the legal profession.

Our firm partners with BlueCross BlueShield of Tennessee and Brainerd High School to conduct Chattanooga's Street Law Diversity Pipeline Program, a nationally recognized educational series with the objective to promote diversity in the legal profession.  Through this program, our teams of lawyers go into the classroom to talk to students about legal careers.  We recently held a one-day conference that provided student workshops that were interactive, real-world examples of careers in the legal arena.

In 2010, members of the firm contributed more than 1,250 hours to pro bono work for clients who could not afford to pay for legal services. Giving back to the community through pro bono legal representation is a cornerstone of Chambliss’ practice.  Chambliss and many of its attorneys provide pro bono legal services to elderly, abused, and low-income residents of our region through Legal Aid of East Tennessee (LAET).  The firm received LAET’s first Pro Bono Firm of the Year Award, and recently, Chambliss attorneys Max Bahner, Bruce Bailey and Bill Carriger were three of the eight local attorneys inducted into LAET's inaugural Pro Bono Hall of Fame.  LAET previously honored William M. Barker, a senior attorney with the firm and former Chief Justice of the Tennessee Supreme Court, for his pro bono contributions by naming its Equal Access to Justice Award after him.  Finally, LAET's Pro Bono Volunteer of the Year Award is named after Bruce Bailey, who was instrumental in starting the Chattanooga Bar Association pro bono program.
