Mass & Toxic Tort Litigation

For over three decades, Connell Foley has defended clients involved in complex mass and toxic tort litigation and handles a wide variety of disputes for chemical manufacturers, building materials companies, pharmaceutical companies, insurance firms, facility owners, and the distributors of allegedly harmful or toxic substances. The Mass and Toxic Tort Litigation group adopts a trial-ready approach based on a rigorous legal and scientific evaluation of the facts and provides clients with knowledgeable, cost-effective counsel throughout the litigation process. We have the experience and scale to serve as national counsel, depending upon the needs of individual clients.

Toxic Tort

Our group offers extensive trial experience in toxic tort cases. We have obtained defense verdicts on behalf of manufacturers, distributors, and premises owners in the mesothelioma and cancer cases in several jurisdictions, including New Jersey, New York, California, and Maryland.

Our group’s defense of toxic bodily injury claims ranges from instances of single-plaintiff occupational disease to multi-plaintiff and class action litigation. Our experienced team has also successfully defended property damage and stigma claims on an individual, neighborhood, and class basis. This includes the successful defense of claims arising from large fires, explosions, and hazardous substance releases.

Our team regularly represents clients in New York, New Jersey, and Pennsylvania, and also serves as national counsel to several clients. As a result of the group’s unique and extensive experience, we are well positioned to assist clients in navigating the complex issues which arise in toxic tort litigation.

Mass Tort

Within the area of mass tort, Connell Foley represents clients in connection with the vigorous defense of mass personal injury and property damage tort claims. We have successfully defended claims relating to exposures to chemicals, over-the-counter medications, large fires, explosions, and other catastrophes, as well as exposures to hazardous substances.

Our team has represented a public utility in one of the largest fire damage cases in the United States, as well as a pipeline operating in connection with a major pipeline explosion that received national media coverage.

We have also represented chemical manufacturers in mass tort cases filed by worksite employees, drug manufacturers for claims filed by consumers, and petroleum companies in matters seeking damages for personal injury and diminution of property value.

Class Actions

Connell Foley has successfully defended and defeated class actions asserted against chemical manufacturers, drug manufacturers, and insurance providers.
