Public Finance

Connell Foley LLP has a distinguished and comprehensive Public Finance group experienced in serving as bond counsel, underwriter's counsel, borrower's counsel, and trustee's counsel in connection with publicly offered, long-term tax-exempt bonds, and other similar financings.

As bond counsel, our Public Finance attorneys have extensive experience assisting borrowers in securing financing of development projects through participation in the New Jersey Environmental Infrastructure Trust/Fund Loan Program which finances landfill closure and clean-up of Brownfields and contaminated properties, water-quality-justified land acquisition, construction of and upgrades to storm water management systems, wastewater treatment facilities, sludge handling facilities, and drinking water projects. For the last several years we have represented the largest participant in this program, the Rahway Valley Sewerage Authority, in obtaining millions of dollars to redevelop its waste water treatment facility.

In its capacity as underwriter counsel on behalf of Morgan Stanley & Co., JP Morgan Chase, and Merrill Lynch & Co., Connell Foley’s Public Finance team has assisted with closing on numerous financings, including bonds and certificates of participation issued by the New Jersey Health Care Facilities Financing Authority, the New Jersey Educational Facilities Authority, the New Jersey Transit Authority, and various municipal and county utility authorities. Our attorneys also have broad experience representing borrowers in obtaining tax-exempt financings. Recent examples include our representation of Seton Hall University in the financing of a new science center and a unit of Railroad Construction Company, Inc. in the issuance of New Jersey Economic Development Authority (EDA) bonds.

Our group also serves as corporate trust counsel for leading financial institutions, including Wachovia Bank, N.A., The Bank of New York, TD Bank, and Wilmington Trust Corp., in connection with a vast array of project financings and is listed in The Bond Buyer's Directory of Municipal Bond Dealers (also known as "the Redbook").
