Real Estate

Conner & Winters attorneys recognize that each real estate transaction is important and financially substantial to our clients.  The deal might involve the purchase, sale, leasing or development of real property; and the interested parties can be businesses, families, developers, lenders, nonprofit agencies, or other types of entities. Our firm’s real estate team is experienced and comfortable in counseling and successfully guiding clients through any real estate transaction.

Helping clients achieve their goals

Conner & Winters has a long history of achievement in real estate practice.  We represent Fortune 100 companies, industrial developers, real estate investment trusts, mortgage bankers and individual entrepreneurs.  For each client, our real estate lawyers maintain a single focus:  we look for the best opportunities to help the client’s business succeed.

Negotiating and closing the deal

On behalf of sellers, buyers and other interested parties, our attorneys have extensive experience in negotiating the best deals for our client.  We routinely negotiate and close on the purchase and sale of a variety of property types, including commercial, residential and agricultural real estate.  We also negotiate and review real estate leases.

Simplifying the complex

Conner & Winters attorneys are not strangers to even the most complex types of real estate deals.  For example, our attorneys are skilled in handling the complexities of “like-kind” real estate exchanges.  Our real estate attorneys work to simplify and streamline complex deals for our clients by working alongside tax lawyers and attorneys in other practice groups.  This multidisciplinary approach enables us to structure transactions that offer the best possible results for our clients.

Advising on financing

As a full-service law firm, Conner & Winters advises its real estate clients on transaction financing matters.  We regularly assist clients in connection with construction loans and other credit arrangements secured by real estate.  Attorneys within the real estate practice work closely with attorneys in other practice groups, including banking and finance, construction, and corporate governance/corporate services.  Our litigation and bankruptcy attorneys represent parties to real estate contracts, as well as borrowers and lenders, in connection with contract disputes or loan defaults that arise when loans are restructured, in and out of bankruptcy.

Counseling on environmental, zoning and other ancillary matters

Our real estate practice group attorneys, in collaboration with environmental and other Conner & Winters lawyers, address and resolve the many ancillary issues that flow from real estate transactions.  We advise clients on environmental law issues as well as zoning restrictions and requirements, easements, and similar property law matters.  We also have experience with Title III Americans with Disabilities Act public accommodations compliance.

Maintaining our professional knowledge base

A host of laws — including federal, state and local laws and ordinances — directly impact real estate transactions.  These legal requirements and restrictions are constantly changing, and these changes can significantly impact the risks and costs of a transaction.  Conner & Winters real estate attorneys are committed to routinely updating our knowledge and understanding of these changing laws.  Our clients can be confident that our representation in any real estate matter will be state-of-the art.
