Premises Liability

The Premises Liability group focuses on the defense of companies, organizations and individuals who own, manage, or provide security services for commercial and residential properties. Carlock Copeland’s lawyers have significant experience in defending on the basis of liability and whether the defendant met the requisite standard of care in the industry. Our experience extends to those cases with traumatic and sensitive nature of the injuries, including catastrophic personal injury, wrongful death and sexual assault.

The causes of action defended by Carlock Copeland include failing to maintain the safety and security of the premises that result in slip and falls, criminal acts or the intentional misconduct of third parties;  allegations of negligent hiring, retention and supervision of staff; and violation of “dram shop” laws.

Representation by the group includes owners and operators of apartment complexes, bars and restaurants, child care/day care facilities, churches, hospitals, hotels/motels, malls, office complexes, schools, and security companies.

As each case presents unique liability and damage challenges, Carlock Copeland’s experience and skill facilitates the use of creative and innovative methods in successfully defending and resolving the litigation.

Legal and practical creativity is often necessary to offset the sympathies generated in these highly charged and often delicate matters. Our representation often includes counsel to clients on practical measures to either avoid or control premises liability claims. In addition, Carlock Copeland attorneys provide in-house seminars, presentations at industry events and host an annual seminar touching on related matters.
