Arrest Warrants


Arrest warrants are based on an affidavit filed by law enforcement officials when they believe there is sufficient evidence to bring charges against someone for committing a felony offense. If a judge issues a warrant based on the affidavit, it authorizes the police to take a person into custody and bring them before a judge for a bail hearing. The judge will decide whether to release the person on bail or to keep them in jail until their trial.

A bench warrant is a legal document issued by a judge when a defendant fails to appear for a court hearing. Sometimes, a judge will set bail at a certain amount enabling the defendant to post bond immediately after being booked into jail. Oftentimes, however, the judge issuing the bench warrant will require the defendant to appear in front of them before considering whether or not to allow them to post bail. If the judge does not allow the defendant to post bail, the defendant will be required to remain in jail until their case is resolved.

A judge issues a probation violation warrant for a defendant's arrest after receiving an affidavit from a probation officer stating that the defendant has violated a condition of probation. The defendant is arrested and brought before the judge for a hearing on the probation violation and to decide whether the defendant will be held in jail or released pending a final disposition of the violation.
