Organized Fraud

The Florida Communications Fraud Act is a law that aims to prevent the use of communications technology in schemes to defraud by consolidating former statutes concerning schemes to defraud and organized fraud. The Act defines "communicate" as the transmission or transfer of signs, signals, writing, images, sounds, data, or intelligences by mail or various electronic systems and "obtain" as depriving someone of property or appropriating it for one's own use. "Property" includes real estate, personal property, and services, and "scheme to defraud" refers to a systematic course of conduct intending to defraud or obtain property through false or fraudulent pretenses or misrepresentations. The Act outlines various offenses and punishments related to schemes to defraud that involve obtaining property of various values.


Under this Act, the following offenses and corresponding punishments apply:


  • If the amount of property obtained through a scheme to defraud has an aggregate value of $50,000 or more, the violator is guilty of a first-degree felony, punishable as provided in sections 775.082, 775.083, or 775.084.
  • If the amount of property obtained has an aggregate value of $20,000 or more, but less than $50,000, the violator is guilty of a second-degree felony, punishable as provided in sections 775.082, 775.083, or 775.084.
  • If the amount of property obtained has an aggregate value of less than $20,000, the violator is guilty of a third-degree felony, punishable as provided in sections 775.082, 775.083, or 775.084.

Additionally, the Act specifies additional penalties for offenses that involve 10 or more victims or the use of a computer or device to facilitate the offense.
