Criminal Mischief

In Florida, criminal mischief is the crime of intentionally or recklessly causing damage to the property of another person or interfering with the use of that property. This can include damaging or altering someone else's property, such as graffiti, vandalism, or destroying property, as well as interfering with the use of someone else's property, such as tampering with a vehicle or cutting a telephone line.


The specific punishment for a charge of criminal mischief in Florida will depend on the value of the damage caused. If the value of the damage is $200 or less, criminal mischief is a second-degree misdemeanor, which is punishable by a fine of up to $500 and/or up to 60 days in jail. If the damage to the property is greater than $200 but less than $1,000, it is a misdemeanor of the first degree punishable by a fine of up to $1,000 and/or up to one year in jail.


If the value of the damage is more than $1,000, criminal mischief is a third-degree felony, which is punishable by a fine of up to $5,000 and/or up to five years in prison. by a fine of. If the value of the damage is more than $200 and the property damaged is a place of worship, a community center, or a school, it is also a third-degree felony, If a person has previous convictions for criminal mischief, the offense for which they are charged will be reclassified as a felony of the third degree.


It is also a crime to intentionally and maliciously damage a memorial or historic property, if the value of the damage is more than $200. This is also considered a felony of the third degree. If someone is convicted of this crime, they may be required to pay restitution to cover repairing or replacing the damaged property.


The criminal mischief statute also allows for the value of damage to property belonging to separate people to be aggregated in determining the grade of the offense, and it allows for restitution to be ordered to cover the cost of damages. Finally, it includes additional fines for graffiti-related offenses.
