Indecent Exposure

A person commits indecent exposure/unlawful exposure of sexual organs if they expose their sexual organs in public or on someone else's private property in a vulgar or indecent manner, or if they are naked in public in a vulgar or indecent manner. This crime is generally considered a misdemeanor of the first degree, punishable by a fine or imprisonment. If a person has previously been convicted of this crime, a subsequent violation is a felony of the third degree, punishable by a fine or imprisonment.


Being nude in public can be a crime in Florida, depending on the circumstances. Under Florida Statute 800.03, it is a crime to be naked in public in a vulgar or indecent manner. This means that if someone is naked in a way that is likely to offend or shock others, or if they are naked in a sexually suggestive way, it could be considered a crime.


However, the statute also specifies that being naked at a place provided or set aside for that purpose does not violate this law. This means that if someone is at a designated clothing-optional beach or at a nudist resort, for example, they would not be committing a crime. It is also important to note that a person's intention or motive is a key factor in determining whether their actions constitute a crime under this statute.


The statute also specifies that the exposure of sexual organs by a mother breastfeeding her baby or an individual naked at a place provided or set aside for that purpose does not violate this law.
