Banking

Attorneys in our Utah offices represent and advise banks and other financial institutions in a number of legal transactions. In addition, we assist them in preparing documentation with respect to all kinds of commercial lending transactions.

Our Key Clients

Along with representing and advising banks and other financial institutions, we prepare documentation with respect to all kinds of commercial lending transactions. We also regularly represent lenders by preparing documentation for loans secured by real property and by performing a legal review of matters associated with the survey, the title policy, the environment, and with zoning. We represent large and small financial institutions and credit providers. These clients include many Utah financial institutions, as well as regional and national financial institutions. We have developed a sophisticated banking and financial-institution practice with many of our lawyers having more than 20 years of experience. Our banking attorneys are located in Salt Lake City and St. George.

Our Banking Attorneys

We have years of transactional experience with commercial, real estate and consumer lending transactions, and we have extensive commercial leasing experience. David Klomp leads our Banking Group and is a senior partner in our Salt Lake City office specializing in banking and financial institutions law. Prior to joining D|J|P, Dave worked for 15 years as the Regional General Counsel for KeyCorp and its predecessors. Our group has demonstrated expertise in resolving risk management issues for its financial institution clients, such as problem loans, workouts and bankruptcy representation. In addition, we also regularly handle commercial collection matters for banks when workouts are ultimately unsuccessful. We have experience with regulatory compliance issues and financial institutions operations, formation and governance issues. In addition, we have also advised banking clients about appropriate policies to include in policy manuals and/or credit manuals, and we have drafted policies to that effect.

Integration with Other Practice Areas

Our Banking Group is integrated with our Bankruptcy and Business & Finance Sections. The members of the group work with other lawyers in the firm to handle complex financings, debt restructurings and workouts, while also servicing the day-to-day financing and other needs of our commercial finance and banking clients. The scope of substantive expertise allows our lawyers to provide business-oriented, practical advice appropriate to both the specialized needs of the client and the specific transaction.
