Most recently, we have developed an extensive experience in mold-related toxic tort claims having represented numerous property owners, contractors, and manufacturers facing such claims throughout the United States.
Members of the firm’s Toxic Tort Practice Group have argued multiple matters before the Federal Judicial Panel on multi-district litigation. They have also represented clients in actions consolidated for coordinated pretrial proceedings by the JPML before federal courts throughout the United States. In addition, Dinsmore & Shohl LLP has assisted clients in establishing a network of local and regional counsel defending mass tort and other complex litigation. We have assisted clients of the firm in retaining experts in various medical specialties in scientific disciplines who can evaluate cases, assist in preparation, and serve as expert witnesses at trial, where appropriate.

International Flavors & Fragrances
Remmes v. International Flavors & Fragrances, et al.
Successfully briefed Remmes v. International Flavors & Fragrances, et al., 389 F.Supp.2d 1080 (N.D. Iowa 2005), in which the United States District Court for the Northern District of Iowa granted the motion to dismiss plaintiff's claims for fraudulent concealment and civil conspiracy against our client. The Court held that Plaintiff failed to plead his fraudulent concealment and civil conspiracy claims with the required degree of particularity. Although Plaintiff was permitted to replead his allegations, the Court subsequently dismissed the claims again in Remmes v. International Flavors & Fragrances, et al., 453 F.Supp.2d 1058 (N.D. Iowa 2006).
Manufacturing Company
Multiple Plaintiffs v. Multiple Manufacturing Companies
Multiple Plaintiffs filed a negligence and product liability lawsuit against multiple manufacturing companies alleging cancer causation resulting from decades of Benzene containing product exposures at a large Steel Corporation's facility. The case against our client was eventually dismissed.
Stockhausen
Frederick Hilton v. Stockhausen, et al.
The plaintiff brought suit for over $1 million against our client, a German-based chemical company. He claimed to suffer neurological impairment as a result of alleged exposure to polyacrylamide flocculant while working at a municipal water treatment facility. The case was eventually settled.
International Flavors & Fragrances, Inc.
Popcorn / Flavoring Litigation
Successfully briefed and argued Mitchell v. International Flavors & Fragrances, Inc. et al., Slip Copy, -- Ohio -- , 2008 WL 2853880, Ohio App. 1 Dist. (July 25, 2008), affirming trial court's granting of summary judgment in favor of our client. 1st District Court of Appeals held that Plaintiff/Appellant was collaterally estopped from relitigating the issue of causation in this product liability action based upon her previous litigation and denial of workers compensation benefits for the same lung injury.
