Appellate Practice

Our reputation for being effective litigators on behalf of individuals and clients from a wide range of industries extends to the state and federal appellate courts.

Success on appeal requires attorneys who know how to achieve it - attorneys who understand sound strategies for effectively presenting a case on appeal, who can navigate the procedural mazes of appellate courts, who craft effective briefs on appeal, and who persuasively handle the challenges of oral argument. As one court of appeals justice has said, "Appellate work is most assuredly not the recycling of trial level work." Different skills are needed on appeal than at trial.

That is why it's important to have attorneys experienced in appellate practice who can combine thorough and imaginative research with compelling writing and skilled oral advocacy. For many years, our attorneys have successfully represented clients in state and federal appellate courts, including all Michigan appellate courts, numerous federal circuit courts of appeal, and the United States Supreme Court.

Foster Swift's appellate practice attorneys have a wealth of experience, giving them familiarity with the appellate process, appellate justices and judges, and appellate courts' staff.

Each year Foster Swift attorneys are involved in many key cases before state and federal appellate courts. This includes authoring numerous amicus briefs, which have been referenced in many key state and federal appellate court opinions.
