Greenberg Traurig's ERISA & Employee Benefits Litigation Practice comprises a group of litigators including a principal designer and one of the drafters of ERISA, lawyers who have secured precedent-setting verdicts, and several former senior hands in government. In addition, team members include a Law360 “2018 Benefits MVP”; master class presenters and panelists at American Conference Institute’s annual National Advanced Forum on Defending and Managing ERISA Litigation; one of the lead ERISA litigation counsel in the landmark rejection of class certification case, Bacon v. Stiefel Labs, 2011 U.S. Dist. LEXIS 79599 (S.D.Fla July 21, 2011); and one of the few practitioners who is a fellow of both the American College of Benefits Counsel and the College of Labor and Employment Lawyers.
GT litigates employee benefits cases and provides risk assessment and analysis, helping clients anticipate and avoid potential liabilities. We are a single firm resource for ERISA, ESOP, and Employee Benefits litigation issues, defending clients in class actions and single plaintiff matters and advising in government investigations and mergers and acquisitions. Our team works closely with lawyers and professionals in many GT practices to bring a unique and tailored approach to every case, including Benefits and Compensation, Labor and Employment, Tax, Securities Litigation, Health Care & FDA, and Appellate. Our clients include employers acting as plan sponsors and plan administrators, as well as individual and corporate fiduciaries and service providers.
We advise on a broad spectrum of ERISA claims, including fee disclosure; employer stock litigation; benefit discrimination; breach of fiduciary duties; cash balance litigation; claim and claim process litigation; wrongful denial of benefits; DOL investigations; Varity claims; withdrawal liability; complex ERISA preemption issues; ESOP-related disputes; and fiduciary and compliance audits. While the work is complex, our approach is straightforward — we form the best team for each specific situation and formulate a strategic plan to meet client goals.
