We provide advice concerning appropriate warnings to be given users or consumers of products, placement of such warnings, appropriate content for operating or equipment manuals, appropriate timing for design changes, necessity for inspection or testing, compliance with statutes and regulations, and determination of recall or retrofit advisability.
In adversarial proceedings, we have represented clients who manufacture, sell or distribute among other things: heavy industrial equipment, tractors, bulldozers, cranes, lift trucks, oil field equipment, kitchen equipment, tires, pharmaceuticals, medical supplies, bottling equipment, chemicals and glues, fertilizers, tobacco products, automotive equipment, camping equipment, ski equipment, ski lift equipment, textiles, hand tools, consumer products, centrifuges, and more. On the plaintiff's side, we have handled cases against manufacturers of products including bicycles, surgical drills, ultralow temperature freezers, blood products, food, and bovine vaccines.
We have been involved in litigation in both state and federal courts in Kansas, Colorado, Utah, Idaho, Wyoming, West Virginia, Illinois and elsewhere, and have tried both jury and non-jury cases. We keep abreast of statutory changes concerning products liability in all of the jurisdictions in which we practice, and publish and lecture on product liability issues.
