Insurance Litigation

Husch Blackwell's Insurance Litigation Group comprises over 30 attorneys. We currently represent many Fortune 500 insurers in complex insurance litigation matters pending throughout the United States. Our firm actively represents life, health, and major national property, casualty, title and workers' compensation insurers and reinsurers.

Our insurance litigation experience includes, but is not limited to, complicated coverage disputes  involving a large spectrum of coverages including directors and officers (D&O), errors and omissions (E&O), fiduciary liabilities, banking and finance liability and fidelity liability, general commercial liability (GCL), excess, professional liability, credit and real estate title insurance. Our trial attorneys have obtained significant victories in the defense of insurance-related claims based on a wide variety of legal theories and insurance practices, ERISA and non-ERISA claim litigation, complex bad faith and vexatious refusal claims, multi-state market conduct exam litigation, constitutional challenges to statutory enactments, and actions to rescind policies for fraud.

We have also gained a reputation for excellence in the defense of insurers involved in significant class action litigation. We have defeated class certification and obtained dispositive rulings for our clients in cases concerning such issues as the independent contractor status of insurance agents; insurance claims handling and underwriting practices; medical bill review and repricing challenges; med-pay provision issues; calculation of premiums, rates and rate-making; after-market crash part issues; replacement value calculations for homeowners' insurance; and a wide range of other legal theories applied to insurance practices.

We also represent major insurers in litigation matters brought by state regulators throughout the United States.

Many of the country’s most prominent insurers routinely retain us to represent their insureds in all manner of complex litigation including toxic tort claims, products liability actions and professional liability, general comprehensive liability and large excess claims. As such, our attorneys are thoroughly familiar with the responsibilities of insurance defense counsel and the needs of our insurance clients for timely and complete information. We are experienced in following company policies with regard to claim analysis, budgeting, reporting and billing.

We have substantial experience in the context of insurance company insolvency proceedings and the variety of litigation that arise out of such proceedings, including claims adjudication, coverage disputes, and reinsurance and excess insurance issues.

Our trial attorneys have gained a reputation for zealous advocacy, exceptional client responsiveness, as well as success in the courtroom – with an outstanding record of significant trial victories.
