Attorney Liability Defense

Klein Glasser primarily focuses its practice on the representation of fellow attorneys. The Firm’s client base ranges from the solo practitioner to nationwide firms in a diverse spectrum of practice areas and matters.

Regardless of the nature of the claim asserted against the lawyer or the law firm, we are “lawyers’ lawyers”; each client receives the full benefit of the Firm’s unparalleled experience and work product. The Firm has tried multiple professional malpractice claims and has been involved in the creation of much of the law protecting Florida lawyers to this day.

Notable decisions include the first case in Florida adopting judgmental immunity as a defense in a legal malpractice action; as well as the first appellate decision in Florida to determine that there was no joint liability as between predecessor and successor counsel where the successor attorney had ample opportunity to obviate errors caused by the original attorney.

In what was perhaps the Firm’s most notable appellate decision over the course of the last several years, the Firm was successful in convincing the Florida Supreme Court to limit its earlier decision allowing the prosecution of legal malpractice claims by way of assignment. In David J. Stern v. Security National Servicing Corporation, 969 So. 2d 962 (Fla. 2007), the Supreme Court of Florida reaffirmed earlier case law that legal malpractice claims are not generally assignable in all but limited circumstances.

At the inception of the claim, our attorneys and staff vigorously investigate the claims brought against our clients to determine whether an early resolution is feasible or practicable. If an early resolution is not possible, our attorneys provide an energetic and meticulous defense designed around the firm’s commitment to the defense of our fellow colleagues.

In addition to defending lawyers in civil actions, Klein Glasser counsels and advises its clients on business and ethical issues. Klein Glasser also defends attorneys in Bar proceedings, from the initial investigatory stage through the actual trial of a grievance proceeding.
