Antitrust and Competition

“…the advocacy has really been remarkable both on the papers and in the arguments today…It’s been a pleasure to hear so many good litigators advocate their positions.”
-Judge Viktor V. Pohorelsky, United States District Court, E.D.N.Y
, In re Air Cargo Shipping Services Antitrust Litigation

The free market only works when participants play by the rules. When the rules are broken – through price-fixing, monopolization, bid-rigging and other anticompetitive behaviors – the system breaks down to the detriment of consumers and businesses alike.

Labaton Sucharow Works to Level the Playing Field
With our tenacious advocacy and savvy litigation strategy, we have secured monetary and equitable recoveries of more than $2 billion in major antitrust class actions filed in the U.S. and around the world. Our success has allowed us to represent a diverse range of clients from small family businesses to multibillion dollar corporations, governmental entities and institutional investors, pursuing cases against some of the largest companies.

Our attorneys are not afraid to push the bar, bringing cases that go beyond price-fixing conspiracies—the standard fare for some firms. We've brought cases involving monopolization and other predatory practices and also hold an impressive track record of representing multiple levels of direct purchasers in large and complex antitrust cases.

A "Firm of Firsts," we were the first to file nearly two dozen antitrust class actions in the country, sometimes beating even regulators to the punch. These novel and often high-profile cases often spark dozens of follow-on actions across the country.

We were first to investigate and then file class actions in the following important antitrust cases:

  • In re Air Cargo Shipping Services Antitrust Litigation
  • In re Flat Glass II Antitrust Litigation
  • In re Platinum and Palladium Antitrust Litigation
  • In re SSA Bonds Antitrust Litigation
  • In re Treasury Securities Auction Antitrust Litigation
  • UFCW Local 1500 Welfare Fund v. Dr. Reddy’s Laboratories, Inc. (Generic Divalproex Antitrust Litigation)

Our Team
Our practice leverages the experience and expertise of longtime leaders in the antitrust bar. We count among our ranks a former Bureau Chief and Assistant Attorney General of the Antitrust Division of the Office of the New York Attorney General; a former trial attorney with the Department of Justice Antitrust Division; and a former in-house attorney at a telecommunications company. This highly relevant, in-the-trenches experience informs our practice and legal strategies, enabling us to provide our clients with commercially minded counsel balanced by prosecutorial insight.

Diversity

Committed to fairness and equality for our clients and for ourselves.

Labaton Sucharow believes that a variety of viewpoints and backgrounds leads to better insight and better lawyers. We strive to improve diversity within the Firm and the legal profession as a whole.

Fifty years ago, the founding partners of Labaton Sucharow established a platform to promote fairness in business enterprise. It worked. Over the last five decades, our Firm has earned global recognition for extraordinary success in securing historic recoveries and reform for investors and consumers. That's justice in action.

But let's face it: a commitment to fairness and equality does not begin with client engagements. It begins with our people.

We firmly believe that there is strength and value in diversity and we actively aim to hire minority and female attorneys, professionals and staff. We have built a work environment where everyone can thrive: an environment where our practices and programs support our values.

The Labaton Sucharow Minority Scholarship and Internship

Demonstrating our commitment to diversity in law and to introduce minority students to Labaton Sucharow, in 2006 we established the Labaton Sucharow Minority Scholarship and Internship. The annual award -- a grant and a summer associate position -- is presented to a first-year minority student from a metropolitan New York law school who has demonstrated academic excellence, community commitment and personal integrity. Several scholarship recipients are now full-time attorneys with the Firm.

The Firm has also instituted a diversity internship in which we invite two students from Hunter College to join us each summer. These interns are rotated through our various departments, shadowing Firm partners and getting a feel for the inner workings of a law firm.
