Labor Market Attachment

When you are injured on the job, your injury entitles you to workers’ compensation benefits for a limited amount of time. The extent of your injuries may affect the type and duration of compensation you will get. If your physician has stated that you have a partial, rather than total, disability then, in order to eligibility for lost time payments you must maintain some level of attachment to the labor market. An experienced workers’ compensation attorney can help you through the process of proving this and obtaining the benefits you deserve.

Proving a labor attachment

If you have been injured in the workplace and are now considered partially disabled, you are required to look for a job within your restrictions if your restrictions prevent you from being able to carry out your old job. If you do not search for a job suited to your abilities, you could be found to have withdrawn yourself from the labor market. If this happens, the Workers’ Compensation Board cannot award you indemnity benefits, although your medical benefits will still be payable. This means that you will not be compensated for lost wages and made financially “whole”, but you will still be provided medical care and rehabilitation. If you are considered totally disabled, you are not required to prove that you have maintained a labor attachment.

Proving your attachment to the labor market can be difficult without a workers’ compensation attorney. If you cannot prove your labor attachment, the insurance company can suspend your indemnity payments until you can prove that you have reattached yourself. Workers’ compensation attorneys will be able to assist you in gathering the documents and records necessary to prove this, including interviews, job applications, and registration with employment agencies, etc. Your search for employment should be based on your restrictions, not the amount of money the job will pay.  IF you find a job which pays less than what you were earning prior to your injury you may be eligible for “reduced earnings” payments from the workers compensation carrier.
