Insurance Coverage and Defense

Loeb & Loeb’s Insurance Coverage and Defense Practice offers counseling and litigation services to help leading insurers, reinsurers, insurance brokers and insureds anticipate problems and avoid or mitigate insurance claims, losses or damages. Our practice brings a wide variety of experience to the table, from advising clients on coverage and exclusions to handling insurance and reinsurance disputes and arbitrations in jurisdictions throughout the country. 

Our clients include major insurance companies, brokers and intermediaries, as well as policyholders from a range of industries, including real estate, financial services, retail, entertainment and media, advertising, and technology. In the healthcare field, we also have extensive experience representing third-party administrators and claims administrators for self-funded employee benefit plans.
 
Our attorneys help insureds interpret policies, analyze coverage, determine where coverage is lacking and, where appropriate, establish or pursue coverage for claims brought against them. We assist both insurers and policyholders in rendering coverage opinions and handling difficult placement issues. We also represent insurers, insureds, brokers and intermediaries in contentious insurance matters. Approved and retained by leading insurance carriers to represent their insureds in defense of claims, we have been successful in working out creative split-fee arrangements with insurance companies and their policyholders.
 
When disputes arise, we strive to achieve favorable out-of-court outcomes for clients through mediation and alternative dispute resolution. Title Insurance
As recognized leaders in title insurance law, Loeb & Loeb represents most of the industry’s leading title insurers in issuing and evaluating policies, rendering coverage opinions and resolving title disputes on behalf of their insureds. We also represent title insurance carriers in coverage disputes and claims. Our attorneys have substantial experience handling all aspects of title litigation arising from insurer liability and title insurance coverage claims.
 
Broker Liability Insurance
We represent some of the world’s largest insurance brokers in a wide range of matters such as enforcement of restrictive covenants actions and claims alleging broker liability in connection with errors and omissions coverage. From the negotiation table to the courtroom, we are strong advocates for our insurance market intermediaries.
 
Environmental Insurance
We regularly represent insureds in negotiating policy terms, filing environmental claims for defense and indemnification costs under comprehensive general liability insurance policies, and securing defenses and settlements in complex environmental insurance coverage claims.
 
Property and Casualty Insurance
Our practice encompasses the full spectrum of property and casualty insurance coverage issues and disputes. We have defended claims involving major commercial property damage and business interruption losses, product and inventory losses, and disputes relating to the scope of coverage and exclusions.
 
Directors and Officers Insurance
Our attorneys litigate and arbitrate disputed directors and officers (D&O) insurance liability claims and advise clients on all aspects of D&O insurance, including issues related to complex corporate transactions, securities litigation and government investigations.
 
Reinsurance
We also represent insurers and reinsurers in disputes relating to the scope of coverage under both facultative and treaty policies.

Recruiting and Retention
The Workplace Diversity and Inclusion Committee assists and monitors Loeb & Loeb’s ongoing efforts to promote and achieve its diversity goals, especially the goal of meaningfully increasing the representation and retention of women and minority lawyers at all levels of the firm. The committee advises firm management regarding procedures for enhancing the recruitment, retention and promotion of diverse attorneys, and provides input on ways to integrate diversity goals into everyday decision-making, policies and management practices.
Affinity Groups
Loeb & Loeb attorneys and staff members are active in four affinity groups: Attorneys of Color, LGBT, Women and Parents. These groups provide a voluntary support network designed to create a more inclusive culture, enrich the work environment, and identify solutions and strategies that help the firm recruit, develop, advance and retain talented attorneys. Through thoughtful discussion of topical issues and identification of best practices, our affinity group members are able to drive meaningful change and promote a culture of collaboration and positive action.

Mentoring
Encouraging the professional growth and development of our attorneys is an important focus at Loeb & Loeb. It is key to the success of our attorneys, our firm and our service to clients. Our mentor program provides associates with the structure and framework needed to build skill sets and develop valuable professional connections. Through both informal and formal mentoring, senior lawyers share their experience, knowledge and insight to help guide associates on the path to become future firm leaders.

Community Outreach
Our commitment to diversity is enhanced by our active involvement as members and sponsors of several organizations that support and reflect our diverse society, such as the California Minority Counsel Program and Lambda Legal. We also participate in programs that promote diversity in the legal profession, including the recently expanded Judicial Intern Opportunity Program from which the ABA Section of Litigation places law students of color and those from disadvantaged backgrounds into judicial internships.

In addition, we are a signatory of the Diversity Statement and Policies promulgated by the New York City and Los Angeles County Bar Associations. Both of these initiatives call upon law firms to hire diverse incoming classes and to maintain this diversity as associates rise in seniority and are considered for partnership.
