McManis Faulkner handles all types of general civil litigation, including civil rights, class action claims, intellectual property and securities. We represent public and private corporations in high tech and other industries, as well as individuals and public entities.
As a full service litigation firm, we are able to represent a client in parallel cases (e.g. representing a client in a civil action while handling a criminal or family law case), saving the client time and the expense of multiple representation. We strive to reach the best possible results as cost effectively as possible.
While most cases we handle are filed in the state and federal courts of Santa Clara County, the cases are often national in scope, and we have been involved in complex cases against some of the largest law firms in the country. We have also served as local counsel for national firms.
Representative General Civil Litigation Cases
MF represented Intel Corporation in an action for misappropriation of trade secrets against Broadcom Corporation, following Broadcom's employment of three former Intel engineers in a competitive field. After Intel obtained injunctive relief against Broadcom, the case settled.
MF obtained a $45 million settlement from a renowned medical device manufacturer in a consumer fraud action brought in both federal and state courts, on behalf of a nationwide class of hundreds of thousands of diabetic consumers in In re LifeScan, Inc.
MF has represented numerous clients in lawsuits where individuals have sued or been sued by a public entity (i.e. local, state or federal). These lawsuits have often involved government abuse of authority. We represented Al Ruffo, former Mayor of San Jose, to stop the City of San Jose from using $50 million in redevelopment money to pay for San Jose's City Hall. In another case MF successfully represented a homeowner who was fined more than $100,000 for alleged code violations, succeeding in having the amount of fine reduced to less than 10% of that amount.
In the Boulder Ridge case, MF represented homeowners who were opposed to the construction of high-density housing adjacent to a proposed golf course in the Almaden Valley. After protracted litigation, the case was successfully settled.
