Mendes directly handles and supervises errors and omissions (E&O) claims for a wide variety of professions including: insurance brokers; architects and engineers; court clerks and other public officials; travel agents; art dealers; and professionals affiliated with banks, investment banks, and securities and brokerage houses.
We have also drafted various errors and omissions policies for the insurance market, including the Lloyd’s line slip. As London market insurers have become active in this area, Mendes has assembled programs to write errors and omissions business.
Monitoring counsel for E&O programs
In this role, our lawyers have provided coverage advice, and supervised local defense counsel across the U.S. We have also handled overall claims administration, including the settlement of claims under limited settlement authority granted by our clients.
The firm’s sophisticated information technology department has created claims-reporting databases to process and electronically report individual claims and provide critical statistical information to insurers, which is available through the firm’s secure Web portal. This capability was a valuable asset to two insurance carriers and their reinsurers when Mendes acted as third-party administrator for 2,000 school board E&O claims.
Dispute resolution
Mendes has litigated matters arising out of insurance coverage for liquor law liability, municipality/public official errors and omissions, school board errors and omissions, and many directors and officers matters.
